Abstract Greenfields agreements, made between employers and unions in respect of a ‘genuine new enterprise’, offer employers the certainty of a statutory agreement from the very beginning of large projects. The Fair Work Act 2009 (Cth) introduced greater restrictions on how greenfields agreements may be made and curtailed some of the excesses of Work Choices. In submissions to the Fair Work Act Review and the Productivity Commission, employer groups have raised concerns that this threatens investment by handing too much power to unions. This article considers the Coalition response to such concerns, in the form of proposed amendments to the greenfields agreement-making process. In doing so, it discusses the use, purpose, and historical development of this special kind of enterprise agreement. Ultimately, it concludes that the proposed amendments make a good faith attempt to work within the framework of the Fair Work Act, which suggests that the Coalition has accepted the need for substantive and effective employee protections.
